USCIS No Longer Accepting Pending LCAs

On March 10, 2010, the U.S. Citizenship and Immigration Services (USCIS) announced that it would not extend the period in which it temporarily accepted H-1B petitions filed with uncertified Labor Condition Applications (LCAs).

In November 2009, USCIS announced that it would temporarily accept H-1B petitions filed with uncertified LCAs as a result of processing delays by the Department of Labor. As of March 10, 2010, USCIS will reject any H-1B petition filed without an LCA certified by DOL.
