Divorcing parties may want to resume her (or his) former name, or perhaps they want to change the name of the child. Former names may be restored as part of the divorce proceeding, or as an independent action.
Typically, an adult’s name may be changed to anything, as long as it’s not with the intent to defraud. A child’s name may be changed with the agreement of both parents. If one parent disagrees, then the court must be convinced that the child’s name change is in the child’s best interest.
