EB-1 - Multinational Managers/Executives, Extraordinary Ability, Outstanding Professors/Researchers

The first employment based category (EB-1) is reserved for multinational managers/executives, individuals with extraordinary ability and outstanding professors/researchers.  No PERM Labor Certification is required for the EB-1 category.  The immigration team at Szabo, Zelnick & Erickson is skilled and experienced at obtaining immigrant visas and green cards for individuals in this category. This qualifications for the EB-1 category are as follows:

 

MULTINATIONAL MANAGERS/EXECUTIVES

 

  • Permanent offer of employment with a U.S. company
  • History of at least one year of employment (within the last three years) with the U.S. company's foreign branch, affiliate or subsidiary

 

EXTRAORDINARY ABILITY

 

Evidence of a one-time achievement of a major international recognized award (e.g. Nobel Prize), or at least 3 of the following:

 

  • receipt of lesser nationally/internationally recognized prizes or awards (not including academic awards or nominations)
  • membership in an association in the field which requires outstanding achievement of their members, as judged by recognized national or international experts
  • published material about the person in professional or major trade
  • publications or other major media participation as a judge of the work of others
  • evidence of original scientific contributions of major significance authorship of scholarly articles
  • artistic exhibitions or showcases of performance in a leading or cultural role for organization or establishment that has a distinguished reputation
  • high salary or remuneration in relation to others in the field
  • commercial success in the performing arts 

 

OUTSTANDING PROFESSORS/RESEARCHERS

 

  • International recognition as outstanding in a specific academic area
  • 3 years experience in teaching or research in the academic area
  • Permanent offer of employment that includes research with an employer that employs at least 3 full-time persons in research activities and has achieved documented accomplishments in an academic field

At least 2 of the following: 

  • receipt of major prizes or awards for outstanding achievement
  • membership in an association which requires outstanding achievement
  • published material in professional publications written by others about your work
  • evidence of participation as a judge of the work of others
  • evidence of original scientific research
  • authorship of scholarly books or articles in the field
