National Interest Waiver (EB-2)

To obtain an immigrant visa in the second employment-based category (EB-2) without first obtaining a PERM Labor Certification, you must seek a National Interest Waiver (NIW).  The NIW is reserved for exceptional ability in the sciences, arts, or business that will substantially benefit the national economy, cultural, or educational interests or welfare of the U.S.  Examples of basis for NIW include improving the U.S. economy; wages and working conditions for U.S. workers; education, health care, the environment and housing.  Support of an interested government agency can also be basis for NIW. As you have probably read, the bar in qualifying for an NIW filing is quite high. As a result, it's important to make sure that your case is assessed properly at the beginning to avoid a waste of your time and money.
