The U.S. Department of State (DOS) Releases the Visa Bulletin for the Month of September 2010
The EB-1 categories are all current. All chargeability areas, Dominican Republic, Mexico and Philippines are current for EB-2. The cut-offs dates for the remaining EB-2 categories are May 8, 2006 for China and May 8, 2006 for India. For the EB-3 categories, the cut off dates are as follows: All Chargeability – December 15, 2004, China – October 22, 2003, Dominican Republic – December 15, 2004, India – January 1, 2002, Mexico - Unavailable and Philippines – December 15, 2004.
Pursuant to INA § 245(a)(3), aliens with priority dates prior to the cut-off dates shown on the Visa Bulletin will be eligible to file adjustment of status applications during the month of September 2010.
The Visa Bulletin provides information regarding the availability of immigrant visas each month, based on predetermined numerical limits set by law. When the numerical limits are met for a particular immigrant visa category that category is considered oversubscribed. When a category is oversubscribed it is then issued a cut-off date that determines when an individual is eligible to apply for an immigrant visa based on that individual’s priority date.
The Visa Bulletin is updated on a monthly basis and we will provide updates regarding the availability of immigrant visas as they occur.
